Scope and order of precedence
Which document wins when they disagree.
1.1 What this covers
This disclaimer applies to every page on webnuvexa.com, including the service pages, the work and case-study pages, the blog, and all seven legal pages. It covers the text, the design, the illustrations, the code samples and any other material published here.
1.2 Order of precedence
Where documents conflict, they apply in this order:
- The signed statement of work for the engagement.
- A written proposal or quote that both parties have accepted.
- The Terms of Service.
- This disclaimer.
- Anything published on this website, including marketing copy.
Put plainly: if a marketing page says we guarantee a first-page ranking in 30 days, this disclaimer overrides it, and the statement of work overrides this disclaimer.
1.3 Nothing here changes a signed agreement
This disclaimer does not reduce any right you have under a signed agreement with us. Where our liability is limited, it is limited by the Terms of Service, section 8 — which is negotiated with you, not imposed by a web page. A disclaimer cannot and does not attempt to exclude liability that the law does not permit to be excluded.
No guarantee of business results
The most important paragraph on this page.
2.1 No outcome is promised
WebNuvexa does not guarantee, warrant, promise or assure any particular business outcome. That includes, without limitation:
- Revenue, profit, conversion rate, or sales volume. No figure of any kind.
- Search engine rankings or organic traffic. Not a specific position, not a page one placement, not a percentage increase, not a timeframe for either.
- Conversions, leads, sign-ups or pipeline.
- Click-through or impression share on any advertising platform.
- Cost per acquisition, return on ad spend, or cost reduction.
- Acceptance or approval by any third party — an app store, a marketplace, a payment provider, a regulator, a funding body, a review site, or a customer's procurement team.
- A funding round, an investment decision, or a valuation.
- Security outcomes. No claim is made that work we deliver will be free of vulnerabilities, or that any system will be unhackable.
- Availability or uptime of a client system except as set out in a signed Service Level Agreement, and even there as a target with credits, not a guarantee.
- Employment, funding, or any opportunity arising from reading this site.
2.2 Why we cannot promise these things
Not as an excuse — because it is the actual position, and anyone who promises otherwise is misleading you. Outcomes of this kind depend on factors that no service provider controls:
- Your market, your competition, your pricing, your product and your positioning.
- Search engine and advertising platform decisions, which are made by companies whose incentives are not the same as yours, and which change without notice.
- Your own sales process, follow-up, resourcing, budget continuity and internal decision-making.
- Seasonality, macroeconomic conditions and events outside anyone’s control.
- Third-party platforms going down, changing their terms, or withdrawing from your market.
- The quality and completeness of the content, data and decisions you provide.
A provider who guarantees these outcomes is either lying, or has taken money from clients for a promise they know they cannot keep. We would rather be useful and honest than popular and wrong.
2.3 What we do commit to
We commit to process, quality and communication instead, and those commitments are the ones you can hold us to:
- Work that materially conforms to the acceptance criteria in the statement of work, for the warranty period stated there.
- Care, skill and diligence appropriate to the work, applied the way a competent professional would apply it.
- Written notice when something is going wrong, a slipping date, or an assumption that has turned out to be wrong — raised when we notice, not at the end.
- Clear, honest advice about what will and will not work, including where the answer is “not us, try someone else”.
- Placing your objectives above ours when the two conflict, including telling you when a cheaper option would serve you better.
These commitments are contractually real. The outcome claims are not, because they cannot honestly be made.
Estimates are not guarantees
Figures shown on a marketing page are not a commitment.
3.1 Pricing shown on this site
Any price, price range, rate, timeline or delivery estimate published on this website is illustrative. It is a general guide to the shape and scale of the work, not a quotation. It is not an offer, and it is not capable of being accepted as one.
We publish indicative figures because they are genuinely useful for deciding whether we are in the right ballpark. They are not useful as a substitute for a conversation about your specific requirements, which is the only way to arrive at a real number.
3.2 What is not fixed by a published figure
A published figure does not fix price, scope, timeline or deliverable for any engagement. Those are fixed only by a signed statement of work, and only for the scope that document specifies. See the Terms of Service, section 2.
3.3 Estimates given before a contract
An estimate given in an email or proposal before any contract is signed is a best-effort assessment based on incomplete information. It is not a fixed price and not a ceiling. We will tell you when we find something that moves it. See the Terms of Service, section 2.1.
Illustrative examples and benchmarks
Worked examples explain a method. They do not promise your result.
4.1 What the examples on this site are
Where this site describes an engagement, shows a metric, a bar chart, a timeline or a “before and after”, it is doing one of three things, and the distinction matters:
- A hypothetical worked example. Constructed to show how a method works, using illustrative numbers. It is not a record of a real engagement and no client is behind it.
- A description of a real engagement, generalised. Where we describe work we did, we describe the approach and the technical reality. We do not present it as a promise of what a similar engagement would achieve for you.
- A figure supplied by a client and permitted for publication. Even so, it describes one engagement, under one set of circumstances, at one point in time.
4.2 What they are not
- They are not audited, verified or independently measured. Figures are self-reported unless the page explicitly identifies an independent source, and the source’s methodology is not something we can warrant.
- They are not comparable without context. A percentage improvement means nothing without the baseline, the time period, the measurement method, whether the market moved, and what else was happening at the time.
- They are not a forecast. Past performance in one context does not predict future performance in another.
- They are not a promise of repeatability. Where we decline to name clients or attach their logos, that is because we only publish with permission, and a permission is not a general licence to imply their results are typical.
- They are not a testimonial we did not receive. We do not publish invented testimonials, unattributed quotes, or a review score we have not been given.
4.3 Verify independently
If a figure matters to your decision, ask us what it actually measures, over what period, compared to what baseline, and by what method. A provider who cannot answer those four questions has a number they should not be showing you. We would rather answer the question than keep the number.
Third-party links and services
We do not control the rest of the internet, and we do not vouch for it.
5.1 External links
This site may link to websites, services, tools, documentation, standards bodies and platforms operated by other organisations. We do not control them. We have not reviewed all of the content they may now contain, and we do not endorse, recommend or make any representation about them, their operators, their availability, their pricing, their security or their practices.
A link is a convenience, not a recommendation. Following an external link is at your own risk: the site may be unavailable, may have changed since we linked to it, may be operated in a different jurisdiction under different laws, and may collect data under a privacy policy we have not seen.
5.2 Third-party services we name
Where this site names a third-party technology, provider, model, platform or framework — a language, a database, a cloud provider, an API — we do so to explain how something works or because we use it in our own work. That is not a warranty that the service is fit for your purpose, available on the terms you need, or still going to exist next year. Services change. Verify the current terms yourself before you depend on them.
5.3 Third-party content and referrals
We are not responsible for the content of any site we link to, including any content produced by a generative AI system, and we are not responsible for any loss arising from your reliance on it.
If you find a link on this site that points somewhere harmful, misleading or impersonating, tell us and we will review and correct it.
Content is provided as-is
Free of warranty, to the fullest extent the law allows.
6.1 No warranty of accuracy or fitness
This site and its content are provided “as is” and, to the fullest extent permitted by law, “as available”. We make no representation and give no warranty that the content is:
- accurate, complete, current or up to date;
- free of error, omission or inaccuracy;
- fit for a particular purpose;
- complete enough to base a business decision on without your own advice;
- secure, or free of harmful components, despite the security measures described in the Privacy Policy.
6.2 We change and correct
Content may be changed, updated, moved or removed at any time without notice, and we have no obligation to keep any page or any earlier version available. Typographical and factual errors happen despite review; if you find one, tell us and we will fix it.
not yet confirmed: content review process — described accurately, because overstating editorial rigour would itself be a misleading claim.
6.3 Code samples
Where this site shows code, configuration or snippets, they are illustrative. Review them before use in anything that matters. They are provided without warranty of fitness, and using them is at your own risk. Nothing on this site should be pasted into a production system without being understood.
6.4 Nothing here is an offer
Nothing on this site is an offer, solicitation, tender or invitation to transact, or investment, employment or business advice. Nothing here creates a professional or fiduciary relationship. A relationship begins only when a statement of work is signed by both parties.
Not professional advice
The clause that keeps a software agency from being mistaken for a law firm.
7.1 What we are not
WebNuvexa is a digital product and engineering studio. We are not, and do not hold ourselves out to be, a regulated professional practice. Nothing on this site is:
- Legal advice. We are not a law firm, our staff are not admitted to practise law in your jurisdiction, and nothing here is privileged or confidential in the legal sense. We will not advise you on your legal position, your contracts, your obligations or your liability.
- Financial, investment or tax advice. We do not advise on investments, pricing strategy as finance, tax treatment, or the tax efficiency of a structure.
- Medical, health or clinical advice. We are not a clinician.
- Psychological or social-care advice.
- Compliance advice or certification. We build systems and write documentation. We do not certify that your data protection, security, quality or accessibility position complies with any law, standard or regulator, and no statement on this site should be read as such a certification.
- Employment, recruitment or career advice. Nothing here is an offer of employment.
7.2 What to do instead
If you need an answer to a legal, financial, tax, medical or regulatory question, consult a qualified professional who is authorised to give it in your jurisdiction. This is not a brush-off; it is the correct route. A professional who is appropriately qualified, carries the relevant insurance and is subject to professional duties will give you a better answer in less time than we could, because it is their whole job.
We are also happy to implement the technical work that follows from advice you have already obtained. That is the part we are qualified to do.
7.3 Content on this site is not a compliance attestation
Our service pages describe security, privacy and accessibility work that we do. Describing that work is not a claim that any product, system or organisation — ours or a client’s — has been independently assessed against a standard and found compliant. Where you need assurance, ask us for current independent documentation produced by a qualified third party.
No certifications or audits
Explicit, so nobody has to infer it.
For the avoidance of doubt, and because the service pages on this site describe security, audit and compliance-adjacent work:
- WebNuvexa does not hold a SOC 2 Type I or Type II report, an SOC 3, or an ISAE 3402 statement.
- WebNuvexa does not hold ISO/IEC 27001 certification, ISO 9001 certification, or any other accredited management-system certification.
- WebNuvexa is not a certified smart-contract audit firm, a registered cybersecurity auditor, a PCI DSS qualified security assessor, or a penetration-testing body holding any recognised accreditation.
- WebNuvexa does not hold, and has never claimed, a GDPR “certification”, compliance seal or data protection accreditation. There is no such certificate. Data protection is a legal obligation, not a credential.
- WebNuvexa has not been audited by an independent accessibility conformance auditor, and holds no accessibility certification. Our Accessibility Statement is a self-assessment and says so.
- No award, ranking, badge, “top agency” list or industry accreditation is claimed anywhere on this site. Where a third-party list names us, that is their assessment, not ours, and it can be withdrawn by them at any time.
8.1 What we do instead
Where an assurance requirement matters, we say what we can actually provide and what we cannot:
- We will describe the technical measures we apply, on the record, without overstating them. See the Privacy Policy, section 10.
- We will support a client’s own audit by supplying documentation and access, within the scope of our engagement.
- We will help you scope a third-party assessment and work with the assessor.
- Where a certification is a contractual precondition for you, raise it before we start. A certification that takes six months and a fee is not something to discover in month five.
We would rather turn down work that quietly depends on a certification we do not hold than take the money and hope nobody asks.
Our content and your use of it
A limited licence to read the page. Nothing broader.
9.1 Our content
Text, design, code samples, illustrations and the arrangement of this site belong to not yet confirmed: the registered legal entity name or to the people who created them, and are protected by intellectual property law. Viewing this site, in a browser, for your own business or personal purposes, is all you are licensed to do.
You may not copy, republish, resell, scrape at scale, compile into a comparable service, or use any substantial part of this site — including with the attribution removed — without written permission. “Attribution and a link” is not a licence. See the Acceptable Use Policy, section 8.2.
9.2 Names and marks
“WebNuvexa” and the site’s design and identifiers belong to us. Using our name or marks to imply endorsement, partnership, affiliation or approval without written permission is not permitted, and may mislead people about the nature of a relationship that does not exist.
9.3 Your content remains yours
Nothing on this site transfers ownership of anything you send us. See the Acceptable Use Policy, section 4, and the Terms of Service, section 5.
Liability and the terms
Pointing at the clause that actually governs.
This page cannot create, expand or reduce liability. It cannot exclude anything the law does not permit to be excluded, and it cannot override a signed agreement.
Liability between us is governed by the Terms of Service, section 8, which you can read, question and negotiate before signing. A liability limitation agreed in a negotiated contract is a far better protection for both sides than a disclaimer on a web page that nobody agreed to.
If a statement on this website were ever found to be misleading about our liability, that is a problem we want to hear about and correct. Tell us and we will take it down.
